PROBLEMS IN YOUR HOME COUNTRY
As Norwegian being the mother tongue, we can only propose legal assistance in Norway to Norwegian. We undertake all preparations based on their documentation, this if we after evaluation find that they in our mind have a real case. If the problems not to be solved in an amicable way, we had the documents to one of our Norwegian partner, this if the client will bring his case to a Norwegian court.

To facilitate, find below the regulations for different categories of Visa and as the requirements from the Thai Immigration Office is today.

NEW VISA REGULATIONS FOR THE KINGDOM OF THAILAND
EFFECTIVE OCTOBER 1ST 2006
GENERAL
According to the Article 13 (3) of the Ministerial Regulations which stipulated the criteria, practices and conditions regarding the verification, exception and the changes in the VISA requirements B.E. 2545 (2002) dated on the 16thAugust B.E.2545 (2002) states:
Within a six month period, the holder of passport or substitutive Documents which is issued by any country that is approved by the Minister of Interior, under the approval of the Cabinet are allowed to enter a temporarily stay in Thailand for tourism purpose. The said shall be permitted to enter Thailand several times. Each permitted stay shall not exceed (overstep) 30 days, and the total period shall not exceed 90 days from the first day the holder of passport arrived in the Kingdom of Thailand.
This is the main rule, and for tourist purposes only, and effective as of October 1st 2006.
RETIREMENT VISA/ONE YEAR VISA
Most of the people qualified to stay in the Kingdom of Thailand for one year renewable are holders of a retirement/disability pension of minimum B 65.000 a month from their home country, alternatively a Thai bank deposit of B 800.000 as a security deposit.
If married to a Thai lady, the minimum deposit being Bath 400.000. The Pension to be confirmed by the home countries Embassy and or a Consulate if any in the proximity.
It is mandatory to have had a bank account/ made your deposit with a Thai bank minimum 3 months before you apply for the Retirement Visa.
DOCUMENTS TO BE PRESENTED TO THE IMMIGRATION OFFICE
Embassy/Consulate verification that you have a pension of minimum THB 65,000 a month from abroad. Alternatively a confirmation from your Thai bank connection that you have made a deposit of minimum THB 800,000 or if married to a Thai spouse, minimum THB 400,000 in deposit.
A medical certificate from a Thai doctor or a hospital.
A copy of your lease or purchased contract in order to confirm your address in the Kingdom of Thailand.
A confirmation from your Thai bank connection that you are you has been client for minimum 3 months.
EFFECTIVE DATE 1 OCTOBER 2006.
Visa Exemption
Passport holders from 39 exempted countries will be able to enter into the Kingdom of Thailand without visa and remain in Thailand for 30 days per each visit. However, the total should not exceed 90* days within a six month period, counting from the date of first entry. (Official text from Thai Immigration Bureau.)
*A) the text can, and for people not knowing Thailand, lead to a misapprehension.
You can stay in Thailand 90 days, but after 30 days, you have to take a visa-trip.
Most people take a one day Visa –trip to Cambodia and get a stamp for one month.
During a 90 days period you have to take this trip 2 times.
(Visa-trips are conducted by a lot of companies. One trip all included starts at THB 2,000)
*B) (With reservation, companies proposing this service to be consulted.)
After two trips to Cambodia (persons coming to Thailand without visa), and instead of returning to your home country after 90 days, can now legally take the plane to a next door country having a Thai Embassy. The Embassy will issue a single entry tourist visa. When you re-enter Thailand you will receive a 60 day entry stamp which can be extended by 30 days at any immigration office.
This means that you legally can stay in Thailand for an unspecified period of time, this if you comply with what has been stated under *A) and *B).
(Visa-companies are proposing trips under *B) to destinations like Penang. A 2 days package all included starts at THB 15,000 a person.)
EFFECTIVE DATE 1 OCTOBER 2006
Tourist Visa
Nationals of 43 listed countries may enter the Kingdom of Thailand with a tourist visa, and in accordance with the Ministry of Interiors regulations, and for a maximum stay of 60 days and for the purpose of tourism, only.
Other nationals may enter the Kingdom of Thailand with a tourist visa for 30 days.

*C) Each nationality will, and by consulting the Thai Embassy or Consulate in their country of origin be informed on the validity of their tourist visa.
*D) Visitors holding a tourist visa when entering Thailand, can prolong their stay, and in the same way as mentioned under Visa Exemption *A) and * B)
EFFECTIVE DATE: 1 OCTOBER 2006
Extension for Business
*Foreigner must have work permit
*The business has registered capital stocks not less than two million Baht.
*The business must have income enough to pay the salary of their employees, including fringe
benefits for all foreigners in their company’s next year accounts.
*The totals of shareholders in the balance payment (being not less than one million Thai Bath).

*E) Before setting up any sort of business, if not in the name of a Thai spouse/Thai friend, all foreigners (Farang) are strongly advised to consult a qualified Thai business lawyer. One of the principle reasons for the new regulations is to end all sorts of illegal business activities controlled and run by none Thai. Before these new regulations, foreigners could set up so named Co., Ltd. Companies at a cost from THB 10,000 to 50,000 including a work permit.
A lot of this foreign owned companies only purpose was to purchase property in the name of a company, and by so no other sort of activity. This is sort of companies has no value today. Foreigner cannot PURCHASE LAND in Thailand, only lease and for a period fixed at 30 years. Prolongation is up to the landlord. All these past Co., Ltd. Companies are, and with the new regulations in force, not worth the paper they are written on.
The same will apply for many other business activities undertaken by these no unqualified companies. If you are qualified, do not spend tens of thousands on companies not operating in according with the Thai prevailing laws.

NYE VISA REGLER FOR KONGERIKET THAILAND

INNLEDNING
I samsvar med artikkel 13 (3) i de Ministrielle reglene som angir kriterier, gjeldende praksis og betingelser hva angår endringer i de nye Visa bestemmelsene samt unntagelser fra nevnte; B.E.2545 (2002) datert den 16 august B.E.2545 (2002) og med gyldighet fra 1 oktober 2006 er
hovedreglene: I en periopde begrenset til 6 måneder, kan personer som besitter et gyldig pass eller et tilsvarende dokument utsted av et land som er godkjent av Innenriksdepartementet etter samtykke fra Kabinettet oppholde seg som turister i Thailand. Passet gir adgang til flere besøk i landet, men hvert opphold skal ikke overstige 30 dager. Det totale oppholdet i Thailand skal ikke overstige 90 dager, og gjeldende fra første innreisedag.
PENSJONSVISA / ETT ÅRS VISA
De fleste som er kvalifiset til ett års opphold, og med adgang til å fornye ett år hver gangen, er a) personer som mottar en alders eller uførepensjon fra sine hjemland på minst THB 65.000 hver måned. Alternativet er at en til enhver tid kan bevise at en har deponert THB 800.000 hos sin bankforbindelse i Thailand.
Bekreftelse på pensjon, alternativt depositum er obligatoriske vedlegg ved søknad om et langtids Visa. Personer under 50 år; (ikke pensjonsberettiget), men gift og har barn med en kvinne fra Thailand: Denne gruppen kan søke om ett ett års Visa på betingelsen av at den angjeldende sin Thai bankforbindelse usteder en bekreftelse pa at den som søker har deponert et garantibeløp på minimum *THB 400.000. (Kontantbeløpet /depositum må ha stått på konto minst tre måneder før personen kan søke. ALLE SOM HAR MOTTATT ET ETT ÅRS VISA VED Å DEPONERE RESPEKTIVE BTH 800.000 og eller 400.000 TREDJE MÅNED, obligatorisk besøk til IMMIGRATION, kunne fremvise bekreftelse på at det deponerte beløpet står sperret på en egen konto.
OBLIGATORISKE DOKUMENT/BEKREFTELSER
SOM MÅ FØLGE SOKNADEN:
En bekreftelse fra Ambasade og eller Konsulat pa at søkeren har en pensjon på minst THB 65.000 og som hver måned kommer på en Thai bankkonto.
Alternativt en bekreftelse fra søkerens Thai bankforbindelse på minimum THB 800.000 eller
*THB 400.000, dette dersom gift og har barn med en kvinne fra Thailand.
En helseattest fra en Thai lege eller et sykehus.
En bekreftelse pa at søkeren har en fast Thai bank forbindelse.
En kopi av leieavtale eller kjøpekontrakt, slik et dokument som bekrefter at søkeren har fast adresse i Kongeriket Thailand.
PRINSIPP OG MOTIV
Da de sist gjeldende Imigrasjonsprosedyrene ikke er endret siden 1977, har Immigrasjonskontoret forbedret og revidert disse, og i den hensikt å tilby besøkende et bedre servicetilbud, og på samme tid styrke den nasjonale sikkerheten.

Dispensasjon for Visa
Personer i besittelse av Pass fra 39 dispensasjonsland vil ha adgang til a besøke Kongeriket Thailand uten Visa og oppholde seg i landet 30 dager for hvert besøk. Dette nevnt, det totale oppholdet i Thailand skal ikke overstige 90* dager innen en 6. måneders periode,
gjeldende fra første ankomstdag.

*A) Teksten kan, og for besøkende som ikke kjenner Thailand, lett medføre misforståelse.
Personer kan opholde seg i Thailand 90 dager, men etter 30 dager må den enkelte foreta en Visa-tur til et naboland (Cambodia) og få Visa for 30 nye dager. For et 90 dagers opphold må en slik krysse grensen to ganger. Mange selskap tilbyr disse Visa-reisene. Prisen for turer med buss til eksempel Cambodia (en dag), starter fra THB 2000.
*B) Etter to turer til eks. Cambodia,(90 dager i Thailand) og for personer som kom til Thailand uten Visa, tilbys nå turer med fly (fly obligatorisk) og til en Thai Ambasade i et naboland (ikke nødvendig å ta den lange reisen til Skandinavia.Ved Ambasaden får du et engangs-Visa med en varighet for 60 nye dagers opphold i Thailand. Tilbake i Thailand får de som tar denne reisen et 60 dagers stempel fra Imigrasjonen på flyplassen, og som igjen kan fornyes med 30 dager av et Immigrasjonsbyrå.
Dette betyr at en legalt kan oppholde seg i Thailand for en uspesifisert tidsperiode, dette dersom mulighetene nevnt under *A) og *B) blir fulgt.

(Visa-selskap tilbyr na disse turene under *B) til reisemal som Penang. En to dagers tur, alt inkludert starter fra THB 15.000 for hver person.)

Turist Visa
Inbyggere fra en liste pa 43 land kan besøke Kongeriket Thailand på turis-Visa, dette i samsvar med bestemmelsene fra Innenriksministeriet i Thailand, og for et opphold på 60 dager, kun for turisme.
Andre nasjonaliteter kan besøke Kongeriket Thailand med et turist-Visa begrenset til 30 dager.

*C) Før utreise vil de respektive Thai Ambasader / Consulat informere den enkelte om
varigheten av den enkelte besøkende sit opphold i Thailand. Dette nevnt, MÅ DEN REISENDE SELV GJØRE SEG KJENT MED VISA REGLENE.
*D) Besøkende som har et turist-Visa når de ankommer Thailand, kan forlenge oppholdet, og på
samme måten som nevnt under Dispensasjon for Visa *A) og *B) ovenfor.

Gjeldende regler for selskapsetablering
* Utlendinger må ha arbeidstillatelse
* Selskapet må ha en minimum registrert aksjekapital på THB 2.000.000.
* Selskapet må ha tilstrekkelig inntjening til a betale lønninger samt sosiale ytelser til sine loikale og utenlandske ansatte for det påfølgende skatteåret.
* Selskapet sin balanse må til enhver tid fremvise en reserve på minimum THB 1.000.000 av aksjekapitalen.

*E) Før en etablerer noen form for foretningsvirksomhet i Thailand, om ikke I navnet på en Thai ektefelle eller en Thai samarbeidspartner, er utlendinger sterkt rådet til å kontakte en erfaren Thai foretningsadvokat, og la nevnte forestå en mulig etablering. En av hovedårsakene for de nye reglene er å stoppe alt av ulovelig foretningsvirksomhet drevet av ikke Thai borgere.
Før de nye bestemmelsene trådde i kraft, kunne utlendinger etablere såkalte Co., Ltd. selskap og med tilhørende ‘arbeidstillatelse’ fra THB 10.000 til THB 50.000.Det er fortsatt en rekke "useriøse selskap," LAW & business companies som tilbyr både Selskapsetablering og Arbeidstillatelser til "gamle priser," men ved ettersyn er disse dokumentene ikke verd papiret de ble skrevet på.
Mange selskap i prisklassen 10 til BTH 30.000 hadde ikke annet formål enn å kjøpe eiendom. All ervervelse, kjøp av land er forbeholdt Thai statsborgere. Utlendinger kan kun byksle for 30 år, og det er opp til landeieren om nevnte vil fornye leiekontrakten. (Forskrifter fra Thai Land Office.
All form form for foretningsvirksomhet må tilfredstille den nye selskapsloven. La dere ikke lure av såkalte "advokatselskap," og som tilbyr ALT, dette mot honorar dette uten å ta hensyn til de gjeldende regler & forskrifter i Thailand.
